These Terms of Use (the “Agreement”) govern the use and access of the Sanaiee mobile application (the “Platform”), including any content, functionality, and services offered through the Platform, by Sanaiee (hereinafter referred to as “Sanaiee,” “we,” or “us”), a company providing technology services that connect customers seeking home maintenance services (“Customer” or “You”) with independent service professionals (“Professional” or “Service Providers”).
This Agreement constitutes a binding contract between you and Sanaiee (individually a “Party” and collectively the “Parties”). By using the Platform, you acknowledge and agree to the terms of this Agreement. If you do not agree to these Terms, you must discontinue using the Platform immediately.
PART 1: GENERAL TERMS
1. SCOPE OF SERVICES
Sanaiee provides an online platform where Customers can connect with independent Service Providers for home maintenance services, including but not limited to plumbing, electrical work, air conditioning repair, and appliance repair (collectively, “Professional Services”).
– Technology Provider Role: Sanaiee acts solely as a technology intermediary. The actual Professional Services are provided by independent Service Providers, who are not employees, agents, or subcontractors of Sanaiee.
– Contractual Relationship: Any agreement for the provision of Professional Services is directly between you and the Service Provider. Sanaiee is not a party to this agreement.
2. ACCOUNT CREATION AND RESPONSIBILITIES
(a) Registration:
To access the Platform, you must create an account using your phone number or sign in via Google or Apple authentication. You are required to provide your phone number upon registration to enable communication for service requests.
(b) Account Security:
– You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
– If you suspect unauthorized access to your account, notify Sanaiee immediately at support@sanaiee.com.
(c) Accurate Information:
You agree to provide accurate and up-to-date information during registration and service requests. Failure to do so may result in suspension or termination of your account.
3. SERVICE REQUESTS
(a) Placing Service Requests:
You can request Professional Services through the Platform by providing accurate details about the service required and your location.
(b) Request Processing:
– Sanaiee assigns Service Providers based on availability and internal processes.
– You will receive a confirmation when a Service Provider accepts your request.
(c) Cancellations:
You may cancel service requests through the Platform before the Service Provider begins their work. Refunds, if applicable, will be subject to Sanaiee’s cancellation policy.
4. PAYMENTS
– Payment Terms: All payments for Professional Services are made directly to the Service Provider.
– Platform Fees: Sanaiee may charge platform fees for facilitating transactions between Customers and Service Providers. These fees will be communicated at the time of booking.
– Disputes: Sanaiee may assist in resolving payment disputes between Customers and Service Providers but is not liable for payment-related issues.
5. YOUR RESPONSIBILITIES
As a user of the Platform, you agree to:
– Use the Platform solely for lawful purposes and in accordance with this Agreement.
– Ensure a safe and respectful environment for Service Providers during service delivery.
– Avoid fraudulent, abusive, or harmful activities.
6. DISCLAIMERS AND LIMITATION OF LIABILITY
(a) Role of Sanaiee:
Sanaiee provides a technology platform and does not directly offer Professional Services. We are not liable for:
– The quality, accuracy, or outcomes of Professional Services.
– Injuries, losses, or damages arising from Professional Services.
(b) No Guarantees:
The Platform is provided “as is” and “as available” without warranties of any kind.
(c) Limitation of Liability:
To the extent permitted by law, Sanaiee’s liability for any claim is limited to the amount paid by you for using the Platform.
7. INTELLECTUAL PROPERTY
All intellectual property rights in the Platform, including software, design, and content, are owned by Sanaiee or its licensors. You may not copy, modify, or distribute any content from the Platform without prior written permission.
8. USER CONTENT
You may post or share feedback, reviews, or other content on the Platform. By doing so, you grant Sanaiee a non-exclusive, royalty-free license to use your content for marketing and promotional purposes.
PART 2: ADDITIONAL TERMS
9. TERMINATION
(a) By You:
You may delete your account through the Platform or contact us at *privacy@sanaiee.com* for assistance.
(b) By Sanaiee:
We may suspend or terminate your account if you:
– Violate these Terms.
– Engage in fraudulent or abusive behavior.
– Provide false or misleading information.
Termination of your account does not affect any outstanding obligations under this Agreement.
10. MODIFICATIONS TO THE PLATFORM
Sanaiee may modify, suspend, or discontinue any feature of the Platform at any time without notice or liability.
11. CHANGES TO THESE TERMS
Sanaiee reserves the right to modify these Terms at any time. Changes will be communicated through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
